These Terms of Use apply to the sale of prints through the Print Library and are written simply to ensure a safe and transparent sale for both parties.

GENERAL INFORMATION

- The licenses have a validity period of 12 months from the purchase confirmation and may or may not be renewed at the end of the period through the renewal payment;
- The files will be delivered in .Tiff in CMYK and RGB , if you need the files in another format, please let me know, I will be happy to prepare the arts in the best format for your project;
- Remember that colors may vary according to your monitor;
- If you would like to customize any design before purchase, please get in touch to verify the possibility;
- After payment confirmation, the files will be available for download on the website and also by email;
- The Pattern Library is a restricted page to registered brands and only you and your collaborators have access to it. Please do not share with third parties;
- Some prints and/or Illustrations have their own terms of use. Ready carefully the description of each product before completing the purchase;
- By making any purchase at the Pattern Library, you declare that you have read and agree to the Terms of Use. ​
 

ABOUT LICENSING
Licensing x Copyright
- The licensing of prints is, actually, the Right to Use the prints and/or illustrations developed by me or by any member of the Mariana Curti team. Copyright is the right that every creator of an intellectual work has over their creation. This right is exclusive to the author. 
- When purchasing any file, you are aware that the Right of Use refers to that print and/or illustration in its original format and that elements present in the design may be used by me in other compositions, including new prints and/or illustrations.
 

Designs

- The arts will be available in .Tiff in CMYK and RGB color mode;
- Once the payment is confirmed, the arts will be available for download on your Client Page and you will also receive an email to download the files;
- You must check the files at the time of purchase and are also responsible for requesting a sample of the print for printing companies (stamping, graphics or any other production) in order to check the rapport, colors and size before sending it to a production in large scale, to ensure that there is no defect in the file and that you are satisfied with the result. Mariana Curti is not responsible for any printing defects;
- The patterns are design preferably for digital production, therefore there is no standard in the size of the rapport. Its use is not indicated for productions that demand stamping by cylinder or frame. In these cases, it is recommended to buy a collection of exclusive patterns;

 

What I can and what I can not do with the files?
- This licensing allows you to use the patterns and/or illustrations for physical products for sale, including fashion, decor, accessories, paintings, posters, etc.;
- You can recolor, enlarge or reduce the patterns and/or illustrations in order to create a cohesive collection with your products. However, it is not authorized, under any circumstances, to include (including the brand logo) or exclude elements;
- You only have the right to use the Pattern or Illustration and must not use its elements for other purposes;
- No patterns or illustrations may be disclosed in prototypes and/or mockups before purchase;
- The original files must not be shared with third parties and it is the buyer's responsibility to keep the original files safe to protect the content;
- You must not imply, expressly or by implication, that you are the author of the arts;
- You cannot share the patterns and/or illustrations in its digital format on your website, social networks or in any other dissemination media to minimize the risks of copying;
- The patterns and illustrations must not be used in a pornographic or defamatory way.
 

Exclusivity and personalization
- Most designs available in the Pattern Library do not give the right to exclusivity. This means that the prints and/or illustrations will continue to be available for sale, including for other brands that may be considered “competitors” for operating in the same area or commercial branch;
- The patterns and/or illustrations that can be exclusive will be marked on the product. This means that during the licensing period (12 months) the patterns and/or illustration will be exclusive to your brand and will not be available for purchase. After the licensing period, you can renew or waive your exclusivity. In this case, the print becomes available again in the Pattern Library and can be purchased again by other brands without exclusivity;
- You can request the customization of some design (colors, size or small editions) to make the pattern and/or illustration more cohesive with your style and your products. In this case, the custom design will be exclusive to your brand, but the original will still be available for sale;
- Personalization may be subject to an additional charge. Get in touch via email with the information and changes you would like to make and I will carefully check the possibility;
- If you want to have a super personalized collection, pattern and/or illustration, I recommend creating an exclusive collection through the For Your Brand / Exclusive Projects page.

 

LICENSE TERMS

Disclosure and Use of the Arts

- You are not obliged to disclose the Mariana Curti brand when using any pattern and/or illustration on your products. However, you agree that I can use the images and photos of products in my portfolio and as a form of publicity, always promoting the brand, including for architects, decorators and other professionals in the area;
- The purchase is personal and non-transferable and therefore cannot be resold, distributed or transferred to others.

Termination, cancellation and refund of amounts
- The Licensing may be restricted, canceled and/or the end of the dissemination of products with my prints may be requested if the brand does not comply with any of the terms specified in this document. In that case, you must immediately stop selling any product that uses any of my designs;
- When purchasing, I understand that the brand is aware of my artistic style and possible color variations due to the monitor and, therefore, there is no refund for withdrawal after purchase. However, if you are not satisfied with the art, you have a period of 7 calendar days from the date of purchase to inform, through the email ola@marianacurti.com.br so that I can understand your demand and find the best way. to help you;
- In cases of defect in the file, which make it impossible to use the pattern and/or illustration, you have a period of 15 calendar days from the purchase to inform and the file will be corrected and sent within 05 calendar days.
 

Payment methods
- The payment method for purchases at the Pattern Library is exclusively by credit card (through Pagseguro and/or Paypal). Transactions made by Credit Card are usually confirmed on the spot but it can take up to 3 business days.

 

OTHERS
- This document is valid only for licensing images made through the Pattern Library ;
-  If one or more of the provisions of this term is annulled by an agreement between the parties, the validity and legality of the others shall not be affected;
- If one or more of the clauses are not complied with, I reserve the right to cancel, request the interruption of the sale of products with the prints and/or illustrations, or take other appropriate measures to terminate the commercial agreement;
